This Privacy Notice explains how TheBrandRefresh B.V. ("we", "us", "our"), operating the website https://www.thebrandrefresh.com, collects, uses, and shares information about you. It applies to visitors of our website and to people who contact us about our services.

We are the controller for the personal data described here within the meaning of the EU General Data Protection Regulation (GDPR).

2. What data we collect

We collect personal data in the following situations:

  • When you contact us. If you email us or submit a form, we receive the contents of your message and any contact information you provide (typically name, email address, and any context you choose to share about your business).
  • When you visit the website. Our hosting provider processes standard server logs (IP address, user agent, referrer, requested URL, timestamp) for the purpose of operating the site securely and reliably. These logs are retained briefly and not used to profile you.
  • If you become a client. We may process additional information necessary to deliver our services and meet our legal obligations, for example invoicing details and access credentials for platforms you ask us to manage on your behalf.

3. Why we use it (lawful basis)

  • To respond to enquiries: based on our legitimate interest in answering questions about our services, or where you've asked us to take pre-contractual steps (Art. 6(1)(b) and 6(1)(f) GDPR).
  • To deliver services to clients: based on the contract between us (Art. 6(1)(b) GDPR).
  • To run and secure the website: based on our legitimate interest in operating a functional and secure service (Art. 6(1)(f) GDPR).
  • To meet legal obligations: for example Dutch tax and accounting requirements (Art. 6(1)(c) GDPR).

4. How long we keep it

We keep personal data only as long as we need it for the purpose we collected it for, plus any retention period required by law. Enquiry emails are typically kept for up to 24 months unless they become part of an ongoing client relationship. Invoicing and tax records are retained for the period required by Dutch accounting law (currently 7 years).

5. Who we share it with

We don't sell your personal data. We share it only with service providers who help us operate the business, under contract and only to the extent needed:

  • Hosting: Vercel Inc. (United States) hosts and serves this website. Data transfers are protected under the EU–US Data Privacy Framework and Standard Contractual Clauses where applicable.
  • Email: Microsoft Corporation (Microsoft 365) processes incoming and outgoing email correspondence.
  • Transactional email: Resend, Inc. (United States) delivers contact-form messages from the website to our inbox.

We may also disclose personal data where required by law, by a court order, or to protect the rights, property, or safety of our business, clients, or others.

6. International transfers

Some of our service providers are based outside the European Economic Area. Where this is the case, we rely on appropriate safeguards such as adequacy decisions, the EU–US Data Privacy Framework, or Standard Contractual Clauses approved by the European Commission.

7. Your rights

Under the GDPR, you have the right to:

  • Access the personal data we hold about you;
  • Request that we correct inaccurate or incomplete data;
  • Request that we erase your personal data;
  • Restrict or object to certain processing;
  • Receive your data in a portable format;
  • Withdraw consent at any time where processing is based on consent;
  • Lodge a complaint with the Dutch supervisory authority, Autoriteit Persoonsgegevens, or the equivalent regulator in your country of residence.
